Terms of Service

These Terms of Service ("Terms") govern your use of Toey, operated by Han Thien Duc ("we", "our", "us"). By accessing or using our service at www.toey.app, you agree to these Terms.

1. Service Description

Toey is an AI-powered English test-preparation platform offering three programs: TOEIC, IELTS, and English Speaking. It provides listening exercises, reading comprehension, grammar lessons, vocabulary practice, mock tests, AI-graded writing and speaking practice, an AI chat coach, and an AI voice tutor. The interface is available in Vietnamese, English, Japanese, Korean, and Thai. Each program is offered in free and paid tiers, and paid access is per program.

2. Account Registration

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 13 years old to create an account.
  • One account per person — sharing accounts is not permitted.

3. Free and Paid Plans

Free Plan

  • Generous daily practice allowances (exercises, mock tests on free content)
  • Limited daily AI usage (AI coach messages, AI-graded writing/speaking)
  • Basic progress tracking

Pro Plans (per program)

  • TOEIC Pro: $4.99/month, $11.99/3 months, or $37.99/year
  • IELTS Pro: $9.99/month, $22.99/3 months, $39.99/6 months, or $59.99/year
  • Speaking Pro: $3.99/month, $10.99/3 months, or $35.99/year
  • Pro unlocks full content access, greatly increased AI allowances (chat coach, voice tutor, writing and speaking grading), and detailed analytics for that program.

Prices are in USD and charged via Stripe. Current prices, promotions, and exact plan contents are shown on our Pricing page, which prevails if it differs from the figures above. Lifetime plans are no longer sold; existing lifetime purchasers retain their access.

4. Payment and Billing

  • Payments are processed securely by Stripe.
  • Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date.
  • Optional one-time purchases (e.g., AI credit top-ups) carry no recurring charges.
  • You can manage your subscription from Profile → Subscription or via the Stripe Customer Portal.

5. Cancellation and Refunds

  • You may cancel your subscription at any time.
  • After cancellation, you retain access until the end of your current billing period.
  • Your account reverts to the Free plan after the paid period ends.
  • All payments are non-refundable, except where required by applicable law. Your Free plan lets you evaluate the full product before purchasing, and premium AI features (essay grading, speaking grading, or AI voice) are consumed on use — by using them you consent to their immediate performance.
  • We may, at our sole discretion, provide a refund only where a technical problem we cannot resolve prevents you from using the service.
  • There are no refunds on unused subscription time; cancel anytime to stop renewal and keep access until the end of your paid period.
  • Nothing in this section limits your statutory consumer rights where a service is faulty or not as described.

6. Content and Intellectual Property

  • TOEIC® is a registered trademark of Educational Testing Service (ETS). IELTS™ is jointly owned by the British Council, IDP: IELTS Australia, and Cambridge University Press & Assessment. Toey is not endorsed by or affiliated with ETS, the British Council, IDP, or Cambridge.
  • Practice content is created for educational purposes. ETS-sourced materials are used under fair use for study preparation.
  • AI-generated explanations are provided for learning purposes and may contain errors. Always verify with official TOEIC materials.
  • You may not redistribute, resell, or commercially exploit content from Toey.

7. Acceptable Use

You agree not to:

  • Use the service for any illegal purpose
  • Share your account with others or create multiple accounts
  • Scrape, copy, or bulk-download content from the platform
  • Attempt to circumvent usage limits or security measures
  • Use automated tools to interact with the service (bots, scripts)
  • Abuse the AI coach feature (spam, harmful content)

8. AI Features

  • AI features (answer explanations, the Toey chat coach, the AI voice tutor, and writing/speaking grading) are powered by Google's Gemini models and OpenAI models. The specific model may change as we improve the service.
  • AI usage is subject to daily and monthly allowances that vary by plan and program (e.g., free accounts get a small number of AI interactions per day, resetting at midnight Asia/Ho Chi Minh time). Pro plans include substantially higher allowances and, for some features, a monthly AI credit wallet. Current allowances are shown in the app; all AI usage is subject to fair use.
  • AI-generated content (explanations, feedback, estimated scores or band scores) is provided as a study aid only, may contain errors, and is not an official score prediction. Always verify with official TOEIC/IELTS materials.
  • We may revoke AI access for abuse, including scripted requests, prompt-injection attempts, content that violates our AI providers' usage policies, or any attempt to extract data from other users.
  • What is sent to AI providers and how it is processed is described in section 9 of our Privacy Policy.

9. Availability and Modifications

  • We strive for high availability but do not guarantee uninterrupted service. Maintenance windows may occur.
  • We may modify features, content, or pricing with reasonable notice. Existing subscribers keep their current rate until renewal.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

10. Limitation of Liability

Toey is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

11. Privacy

Your use of Toey is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

12. Governing Law

These Terms are governed by the laws of Japan. Any disputes shall be resolved in the courts of Kawasaki City, Kanagawa Prefecture, Japan.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.
