Terms of Service

These Terms of Service ("Terms") govern your use of Toey, operated by Han Thien Duc ("we", "our", "us"). By accessing or using our service at www.toey.app, you agree to these Terms.

1. Service Description

Toey is an AI-powered language test-preparation platform offering four programs: TOEIC, IELTS, JLPT (Japanese-Language Proficiency Test, N5 → N1) and HSK (Chinese Proficiency Test, HSK 3.0 levels 1 → 7–9). It provides listening exercises, reading comprehension, grammar lessons, vocabulary practice, mock tests, AI-graded writing and speaking practice, an AI chat coach, and an AI voice tutor. The interface is available in Vietnamese, English, Japanese, Korean, and Thai; which languages and features are available varies by program. Each program is offered in free and paid tiers, and paid access is per program.

2. Account Registration

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 13 years old to create an account.
  • One account per person — sharing accounts is not permitted.

3. Free and Paid Plans

Free Plan

  • Generous daily practice allowances (exercises, mock tests on free content)
  • Limited daily AI usage (AI coach messages, AI-graded writing/speaking)
  • Basic progress tracking

Pro Plans (per program)

  • TOEIC Pro: $11.99/month or $59.99/year
  • IELTS Pro: $9.99/month, $22.99/3 months, $39.99/6 months, or $59.99/year
  • JLPT Pro: $12.99/month or $64.99/year. The annual plan may include a 7-day free trial for first-time subscribers (card required, charged at the end of the trial unless cancelled; one trial per account). The monthly plan is charged on purchase.
  • HSK Pro: a subscription at $12.99/month or $64.99/year, or a one-time pass or one-time Lifetime purchase, each where checkout offers it. The annual plan may include a free trial for first-time HSK subscribers (its length is shown before checkout; card required, charged at the end of the trial unless cancelled; one HSK trial per account). The monthly plan is charged on purchase; passes and Lifetime are charged once and do not renew.
  • Pro unlocks full content access, greatly increased AI allowances for the AI features that program offers (for example chat coach, voice tutor, writing and speaking grading, JLPT answer explanations and diagnosis), and detailed analytics for that program.

Prices are in USD and charged through our payment provider (customers in Vietnam are charged the equivalent ₫ price shown at checkout). Current prices, promotions, and exact plan contents are shown on our Pricing page (and, for JLPT, on JLPT Pricing and, for HSK, on HSK Pricing), which prevails if it differs from the figures above. Apart from a Lifetime purchase offered at checkout, lifetime plans are no longer sold; existing lifetime purchasers retain their access.

4. Payment and Billing

  • Payments are processed securely by our payment provider; we never see or store your full card details.
  • Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date.
  • Optional one-time purchases (e.g., AI credit top-ups) carry no recurring charges.
  • You can manage your subscription from Profile → Subscription or from the billing portal linked there.

5. Cancellation and Refunds

  • You may cancel your subscription at any time.
  • After cancellation, you retain access until the end of your current billing period.
  • Your account reverts to the Free plan after the paid period ends.
  • All payments are non-refundable, except where required by applicable law. Your Free plan lets you evaluate the full product before purchasing, and premium AI features (essay grading, speaking grading, or AI voice) are consumed on use — by using them you consent to their immediate performance.
  • We may, at our sole discretion, provide a refund only where a technical problem we cannot resolve prevents you from using the service.
  • There are no refunds on unused subscription time; cancel anytime to stop renewal and keep access until the end of your paid period.
  • Nothing in this section limits your statutory consumer rights where a service is faulty or not as described.

6. Content and Intellectual Property

  • Toey's lessons, word lists and their translations, example sentences, explanations, practice questions, mock tests, study plans, audio, images, and the software itself are owned by Toey or its licensors and are protected by copyright and other laws.
  • TOEIC® is a registered trademark of Educational Testing Service (ETS). IELTS™ is jointly owned by the British Council, IDP: IELTS Australia, and Cambridge University Press & Assessment. JLPT is administered by the Japan Foundation and Japan Educational Exchanges and Services. HSK is administered by Chinese Testing International (CTI) on behalf of the Center for Language Education and Cooperation (CLEC). Toey is not endorsed by or affiliated with any of these organizations.
  • Practice content is created for educational purposes. ETS-sourced materials are used under fair use for study preparation.
  • Official HSK sample papers are published by Chinese Testing International and reproduced for study practice; they remain CTI's property.
  • Some content uses open data under its own licence (for example stroke-order data and dictionary sources). Those credits are shown where the data appears, and each source's licence terms apply to that data.
  • AI-generated explanations are provided for learning purposes and may contain errors. Check important points against the official materials for your exam.
  • You may use Toey for your own study. You may not copy, redistribute, resell, publish, or commercially exploit Toey content, in whole or in part, without our written permission.

7. Acceptable Use

You agree not to:

  • Use the service for any illegal purpose
  • Share your account with others or create multiple accounts
  • Scrape, copy, or bulk-download content from the platform
  • Attempt to circumvent usage limits or security measures
  • Use automated tools to interact with the service (bots, scripts)
  • Abuse the AI coach feature (spam, harmful content)
  • Use Toey content to build, train, or populate another product or dataset, including AI models

8. AI Features

  • AI features (answer explanations, the Toey chat coach, the AI voice tutor, and writing/speaking grading) are powered by third-party AI models. The models we use may change as we improve the service.
  • AI usage is subject to daily and monthly allowances that vary by plan and program (e.g., free accounts get a small number of AI interactions per day, resetting at midnight Asia/Ho Chi Minh time). Pro plans include substantially higher allowances and, for some features, a monthly AI credit wallet. Current allowances are shown in the app; all AI usage is subject to fair use.
  • AI-generated content (explanations, feedback, estimated scores or band scores) is provided as a study aid only, may contain errors, and is not an official score prediction. Always verify with official TOEIC/IELTS materials.
  • We may revoke AI access for abuse, including scripted requests, prompt-injection attempts, content that violates our AI providers' usage policies, or any attempt to extract data from other users.
  • What is sent to AI providers and how it is processed is described in section 9 of our Privacy Policy.

9. Toey Creator Program

  • The Toey Creator program lets approved creators earn rewards for promoting Toey. You apply from the Creators page. We may accept or decline any application, and we may suspend a creator account that breaks these Terms or the program rules.
  • Creators earn a commission when someone they referred buys a paid plan, and a bounty for each promo video we approve. Current rates, caps, holding periods and the minimum withdrawal are shown in your Creator dashboard; they may change, but changes never reduce amounts already credited to you. A commission is reversed if the purchase it came from is refunded.
  • Promo videos must be your own, describe Toey honestly, and include your referral link or code. Spam, misleading claims, referring yourself and buying views are not allowed. We review every video before a bounty is paid.
  • Original video files. When you submit a video you may also attach its original file. By ticking the consent box you allow Toey to use that video in its advertising: to edit it (for example shorten it or add subtitles) and to run it on platforms such as TikTok, Facebook and YouTube. This permission is worldwide, has no time limit, and carries no payment beyond the program rewards. You confirm that you own, or have permission for, everything in the video, including music, images and every person who appears in it. Once submitted, you cannot delete the file or withdraw this consent.
  • We may remove an original file at any time, for example after a rights complaint or if it breaks the law. Your video link and the rewards you have earned are not affected unless the video itself breaks these Terms. We report illegal content to the relevant authorities.
  • Balances are kept in USD and paid by bank transfer in Vietnamese dong at the exchange rate on the day of payment. You are responsible for any taxes due on your earnings.

10. Availability and Modifications

  • We strive for high availability but do not guarantee uninterrupted service. Maintenance windows may occur.
  • We may modify features, content, or pricing with reasonable notice. Existing subscribers keep their current rate until renewal.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

11. Limitation of Liability

Toey is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

12. Privacy

Your use of Toey is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

13. Governing Law

These Terms are governed by the laws of Japan. Any disputes shall be resolved in the courts of Kawasaki City, Kanagawa Prefecture, Japan.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.
